If you've ever scheduled an appointment with a Medicare insurance agent, you may have been asked to sign or acknowledge a Scope of Appointment (SOA) before the meeting. Many people sign without fully understanding what it is — or that it's actually designed to protect them.
What Is a Scope of Appointment?
A Scope of Appointment is a required document, mandated by the Centers for Medicare & Medicaid Services (CMS), that an agent must obtain from a beneficiary before conducting any sales presentation involving Medicare Advantage or Part D plans.
The SOA specifies which types of Medicare products the agent is allowed to discuss during the appointment:
- Medicare Advantage plans (with or without drug coverage)
- Medicare Supplement (Medigap) plans
- Medicare Part D standalone drug plans
The agent is only permitted to discuss the product types you agreed to discuss on the SOA. If you checked only “Medicare Advantage” and the agent tries to pitch you a life insurance product or something else entirely, that's a compliance violation.
Why Does This Rule Exist?
The SOA requirement was established after CMS identified patterns of agent misconduct — specifically, agents using Medicare appointments as a foot-in-the-door to sell unauthorized or unrelated products. By requiring agents to document in advance what they'll discuss, CMS protects beneficiaries from bait-and-switch tactics.
When Must the SOA Be Completed?
The SOA must be completed at least 48 hours before the appointment — with two exceptions:
- The beneficiary initiates the contact and requests the appointment
- The appointment occurs within 48 hours of initial contact (in which case the SOA is obtained immediately before the meeting)
The 48-hour rule applies when an agent reaches out to you and schedules an appointment in advance.
Scope of Appointment vs. Scope of Benefits
The SOA only governs what topics can be discussed — it does not commit you to enrolling in anything. Signing an SOA simply means you've agreed to hear a presentation on specific Medicare products. You retain full freedom to decline any plan, end the meeting at any time, or request additional time to think.
Your Rights During Any Medicare Appointment
- You have the right to see the SOA before signing it and to ask questions about what each product type means
- You have the right to add or remove product types from the SOA
- You have the right to end any sales meeting at any time, for any reason
- You should never feel pressured to enroll during an appointment
- You have the right to request the agent's license number and carrier certifications
- If you feel an agent has violated SOA rules or your rights, you can report the complaint to 1-800-MEDICARE or your State Insurance Commissioner
